Terms Of Service:


Our Guests/Customers at UNIT Servers have relatively unrestricted control of their servers and web space, but there are limits to what we can allow on our end to maintain fairness to all of our guests.

This list is subject to change, so our customers should check it frequently.

Definitions:
"we", "us", "our" = UNIT Servers Team (unitservers.com)
"you", "customer", "guest" = A customer/guest of UNIT Servers

Disclosure:

Subscriber agrees that the Company may disclose any and all subscriber information including assigned IP numbers, account history, account use, etc. to any law enforcement agent who makes a written request without further consent or notification to the Subscriber. There are different types of TOS that are split into different categories. They are: Shared Hosting, Gaming Servers, Voice Servers, Dedicated Servers. Please take a look before you commit to purchase.

Copyright:

All content included on UNIT Servers Server's websites, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of UNIT Servers or its content suppliers and protected by United States and international copyright laws. The compilation of all content on UNIT Servers Server's websites is the exclusive property of UNIT Servers and protected by U.S. and international copyright laws. All software used on UNIT Servers Server's websites is the property of UNIT Servers or its software suppliers and protected by United States and international copyright laws.

Content:

All services provided by UNIT Servers may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, unlicensed software or files, or material protected by trade secret and other statue. The subscriber agrees to indemnify and hold harmless UNIT Servers from any claims resulting from the use of the service which damages the subscriber or any other party.

Examples of non-acceptable content or link:

- Pirated software
- "Illegal MP3's" - Consists of copyrighted audio
- Hackers programs or archives
- Warez Sites
- Child Pornography

UNIT Servers will be the sole arbiter as to what constitutes a violation of this provision.

Your Account:

If you use UNIT Servers products and services, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. If you are under 18, you may use UNIT Servers only with involvement of a parent or guardian. UNIT Servers and its affiliates reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders and or services at its sole discretion.

Customer Abuse Policy:

Any attempts to undermine or cause harm to a UNIT Servers's server or customer of UNIT Servers is strictly prohibited. UNIT Servers will pursue legal action to the fullest extent for all abuse of the UNIT Servers network.

Technical Support:

UNIT Servers provides 24 x 7 technical support to our subscribers (except for holidays and short maintenance when we close our center.) We limit our technical support to our area of expertise. The following is our guidelines when providing support: UNIT Servers Server provides support related to your virtual site physical functioning. UNIT Servers does not offer tech support for application specific issues such as cgi programming, html or any other such issue. At this time, UNIT Servers does not offer technical support via phone.

Payment:

Subscriber acknowledges that the nature of the service furnished and the initial rates and charges have been communicated to Subscriber. Subscriber is aware that UNIT Servers may prospectively change the specified rates and charges from time to time. Accepted methods of payment include Visa, MasterCard, Discover Card, American Express, PayPal, Checks, and Money Order.

PayPal payments must be sent to [email protected] At this time, we do not accept any wire transfers. All accepted payments are posted up there, on our website, and at checkout.

UNIT Servers reserves the right to deny Client the use of any payment method for, but not limited to, abuse or misuse of a payment method. Abuse of a payment method may also be grounds for further disciplinary action up to and including the immediate and permanent cancellation of the Client's services or their entire account with The Company. If a check or ACH draft is returned for any reason, the account will be assessed a $30 service charge per item. If payment for the returned check amount and service fee is not remitted in full by 4 P.M. PST the following business day, the server will be deactivated until payment is received and will be subject to regular reconnect fees.

The promotional offer is contingent upon UNIT Servers achieving and maintaining its cost of service goals including but not limited to rates charged to company by its suppliers.

Establishment of this service is dependent upon receipt by UNIT Servers of payment of stated charges. Subscriber agrees that UNIT Servers automatically charges subscriber`s credit card every month. UNIT Servers reserves the right to process client credit cards from 3 to 7 days before the actual due date to ensure that the funds are received by the due date. Credit cards that are declined for any reason are subject to a $1.00 declination fee. Service may be interrupted on accounts that are past due. Service interrupted for nonpayment is subject to a $30 reconnect charge. Accounts not paid by due date are subject to a $10 late fee unless customer notify UNIT Servers's Billing Department ahead of time. Accounts that are not collectable by UNIT Servers may be turned over to an outside collection agency for collection.

If your account is turned over for collection, you agree to pay UNIT Servers a "Processing and Collection" Fee of not less than $50 nor more than $150. If you desire to cancel your account, please follow the proper procedure to do this as outlined in this TOS. Co-location servers that are terminated for nonpayment will be considered abandoned and forfeited after 30 days. All payments to UNIT Servers are nonrefundable unless it is UNIT Servers fault or mistake. This includes any setup fee and subsequent charges regardless of usage. All overcharges or billing disputes must be reported within 30 days of the time the dispute occurred. If you dispute a charge to your credit card issuer that, in UNIT Servers sole discretion is a valid charge under the provisions of the TOS and /or AUP, you agree to pay UNIT Servers an "Administrative Fee" of not less than $40 and not more than $150.

Subscription Policy:

All web-hosting packages, gaming servers, voice servers, or any other types of services provided by UNIT Servers, besides dedicated servers, are subscriptions. It is the clients' responsibility to cancel the subscription BEFORE their next billing date. No refunds will be given for customers who do not cancel their subscription in time. All billing is based on anniversary billing, and you will be billed one month from the day you signed up, every month, until you cancel. Please note that UNIT Servers can charge you up to 3 to 7 days before payment is due to continue with service. For users who have signed up for three (3), six (6), or twelve (12) months, you will be billed based on the amount of months subscribed for every term until a cancel request is made. Please read "Cancellation Policy" to cancel your order. No refunds will be given if it's the customer's fault for not cancelling the services provided by UNIT Servers.

Suspension/Deactivation:

 If any terms or conditions are failed to be followed it will result in grounds for account suspension or de-activation. UNIT Servers reserves the right to remove any account without prior notice. If UNIT Servers deactivates your account(s) for violating policy, your will forfeit your rights to a refund -- and none will be given. No refunds for advance payments, on deactivated accounts. Normal policy is a warning first, and second warning can lead to a suspension term or account de-activation for second offense. Serious offenses may cause immediate de-activation. UNIT Servers will be the sole arbiter as to what constitutes a violation of this provision. (b) If there is any frauds payment , investigations, or sign of fraud activity, UNIT Servers has the rights to suspend or terminate your account upon further notice. We will make sure there is no fraud on any payments before we set up your server and also during your server period. We have the rights to terminate or suspend if we find any fraud payments.

BACKUPS AND DATA LOSS

Your use of the service is at your sole risk. UNIT Servers is not responsible for files and data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on UNIT Servers Servers.

48 Hours Money Back Guarantee (2 Days) & 5 Days on MineCraft Servers Only:

a. If for whatever reason you are not satisfied with your game servers or web-hosting, You reserve the right to request a refund within 48 hours (2 days) of server creation. You will be refunded full total amount if paid with original pricing and no coupons or specials. Minecraft Servers have an exception of 5 days money back guaranteed. b. The 48 Hours Money Back Guarantee is only offered on Game Servers, Web Hosting, Ventrilo Servers ordered directly through the website paying at the normal price. Any coupons used or specials will not be refundable at all, no exceptions. Minecraft Servers have an exception of a "5 days money back guaranteed".

c. The 48 Hours Money Back Guarantee excludes the following services: Domain Registrations, Setup Fees, Dedicated/Virtual Private Servers. These are non-refundable at all.

d. All Minecraft Servers have an exception of a "5 days money back guaranteed". All rules will still apply on our agreements.

Cancellation Policy:

Client must submit service cancellations by opening a ticket through our client portal at least 7 days but not more than 30 days before the end of the service's billing cycle. Cancellation requests are not accepted through fax. Cancellation must be made either through a support ticket, emailing [email protected], or through our live support. You must have all account information to cancel an account. Only the authorized account holder may cancel the account. No sub-users or co-authorized account holder may cancel the account.

In the event of cancellation, customer will automatically be billed for any excess bandwidth usage during the then-current monthly billing cycle.

Excessive Bandwidth Use:

Client agrees that bandwidth usage shall not exceed the number of gigabytes per month for the services ordered by Client. UNIT Servers will monitor Client's bandwidth usage and will provide RTG graphs of bandwidth usage for Client to review in the UNIT Servers client portal. UNIT Servers shall have the right to take corrective action if Client's bandwidth usage exceeds the amount allocated by Client's service plan ("Allocation"). Such corrective action may include the assessment of additional charges, disconnection or discontinuance of any and all services, or termination of this agreement, which actions may be taken is in UNIT Servers sole and absolute discretion. UNIT Servers believes in communicating with our clients and will try to work with our clients to resolve any overage issues before taking action which could cause a client's service to become unavailable.

Bandwidth usage is measured on a monthly basis coinciding with Client's billing cycle. Both incoming and outgoing traffic are counted. In the event that a customer exceeds the included allocation, UNIT Servers may, at its sole discretion, collect a deposit in the amount of $0.50-$1.00 per GB for the projected overage for the month, immediately against customer's credit card on file with UNIT Servers.

Client agrees to pay UNIT Servers any additional fees for bandwidth overages within 3 days of the invoicing period at a rate of $0.75 per GB of bandwidth used over the Allocation. Any bandwidth overage bill not paid within three (3) days of invoicing will subject the server and services to suspension.

Unused bandwidth allocations cannot be carried over to future months, or applied to other servers.

Account Termination:

 Violation of our anti-spam policy will be grounds for immediate account termination. Web sites deemed offensive, pornographic or racially degrading, by UNIT Servers, will be removed from our servers without notice. Web sites promoting, making available or otherwise contributing to software piracy, hacking, spamming, denial of service attacks and/or damage to commercial networks or servers will be removed from our servers without notice and illegal acts will be reported and prosecuted. Abusive behavior of any type will not be tolerated. We do not support fraud payments and all services will either be suspended or terminated upon investigation.

Accounts using up enough server resources, to slow or crash a server, will be shut down without notice. If an account is shut down, due to server resource issues, we will (upon request) make a reasonable effort to help get the account out of suspend. This includes tracking down the offending program, if applicable, and/or making available other arrangements for hosting the account on a semiprivate or private server (additional fees may be required).

Server Activity:

All server activity is logged. Any snooping, hacking, or other inappropriate activity of any type outside of your account, on our servers, will be grounds for termination. In addition, your account is for web and email use only, any other activities, at our sole discretion, will be grounds for termination as well.

Breach of Terms of Service:

If any terms or conditions (web-hosting, web user, dedicated servers/vps, game servers, etc) are failed to be followed, it will result in grounds for service suspension or deactivation. UNIT Servers reserves the right to remove any account or service without prior notice. If UNIT Servers deactivates your service or account(s) for violating policy, you will forfeit your rights to a refund. No refunds for advance payments on deactivated accounts. Serious offenses may cause immediate deactivation WITHOUT WARNING!

Courtesy Transfer Service:

UNIT Servers performs all account transfers, account moves, cPanel transfers, server transfers and any other service which involves UNIT Servers copying files of yours from a third party service to your UNIT Servers service, hereafter known as a "transfer" as a courtesy service only. By requesting UNIT Servers to perform a transfer you agree indemnify and hold harmless UNIT Servers from any and all liability arising from the transfer and/or copying of your accounts. You also agree UNIT Servers is not responsible for any issues relating to the transfer of your accounts, both on your UNIT Servers service and at any other third party service from which UNIT Servers may be transferring your accounts from, including but not limited to, missing or corrupted files, improperly transferred accounts, any and all fees you may incur from third party services such as bandwidth fees or charges from delays in transferring account, settings or files from third party providers which may not transferred, any downtime or outages, DNS problems, accounts set up on incorrect IP addresses, any issues at third party services which delay or prevent UNIT Servers from performing the service, or any other issues. UNIT Servers makes no guarantees regarding the availability of our transfer service or the amount of time it takes to perform transfers.

Domain Name Registration and Renewal Policy:

UNIT Servers will make every effort to register and/or renew your requested domain name. This is not a guarantee that your requested domain name is available for registration and/or renewal. Your domain name may go unregistered and/or renewed, due to circumstances beyond our control, and will not be grounds for compensation of financial loss. An order for domain name registration and/or renewal, does not guarantee domain name registration and/or renewal. Domain names will not be registered and/or renewed until payment is received. If requested domain name is not registered and/or renewed by UNIT Servers, the domain registration fee will be refunded.

Domain registration fees are not refundable. If we register a domain name, on your behalf, as part of a free registration promotion - cancellation or termination of your account will void the promotion offer and you will be charged for your remaining time of the domain name registration.

All domain names, registered by UNIT Servers, are done so in the name of the customer placing the order.

Changes to the Terms of Service:

This Terms of Service may be amended, at any time, at the discretion of UNIT Servers. All accounts are required to comply with any changes made to these policies.
Such changes, modifications, additions or deletions shall be effective immediately upon posting on-line at http://unitservers.com . You acknowledge and agree that it is your responsibility to review this site and this TOS periodically and to be aware of any modifications. Your continued use of the services after such modifications will constitute your: (a) acknowledgment of the modified TOS; and (b) agreement to abide and be bound by the modified TOS. If you do not agree to these terms, please contact us to cancel your services or any other cancellation ways that was posted up there.

If you are unsure if what you are doing is against our TOS, please contact us. There are no refunds granted for accounts terminated due to TOS violation.

Misc

- We reserve the right to refuse service to anyone at any time for any reason.
- The Company is not responsible for data integrity on equipment reclaimed for non-payment.
- There are no taxes in any states due to intangible items/virtural services.
- Anything not explicitly stated in this TOS is subject to interpretation at UNIT Servers 's sole and absolute discretion.
- You, as UNIT Servers 's client, are solely responsible for the content stored on and served by your UNIT Servers service.


Any policies not listed are expected to be questioned by the customer BEFORE service starts. If an item is not listed in this TOS, the customer will get a full explanation (If Requested) before service, thus entering a verbal agreement with UNIT Servers.
